My general rule is that a mystic can take any type of spell magic, at a level which would be appropriate for a wizard (so, for example, they can get Call Lightning at 6th level like a wizard, not 3rd level like a Warlock).

That said, their effects are somewhat limited in scope compared with, say wizards. I sometimes think that summoners and diabolists should have been revamped and possibly combined in 2nd Edition, and written up in such a way that ward/circle knowledge is something to be acquired, rather like wizards...

I would go with "It is a surprise attack if the attack is a surprise." If you flat-foot smack someone not expecting it, that's a surprise attack whether your fist is involved or not. However, if they're expecting the punch, it's not a surprise attack.

If you're talking an NPC, just give the NPC the magical powers of the OCC you want them to have, and any skills you think are necessary for that.

Generally, I go with magic items being relatively immune to mundane wear and tear. They can be broken... grab the amulet chain and yank and it can break... but they won't usually fall apart during normal use.
